Notice according to Gov. Decree no. 196 dated 30 June 2003

In accordance with article Gov. Decree no. 196 dated 30 June 2003 we inform you that Mager s.r.l. will process your personal data only for the purposes related to the supply of goods and/or services to your company. Processing will be carried out as follows.

1. Processed data
Processed data are: personal, accounting and fiscal data; phone and fax numbers, e-mails; bank accounts details; data related to the company organization, data related to the correct fulfilment of obligations; statistical data about sales; other company data necessary to the fulfilment of supply of goods and/or services.

2. Purposes of data processing
Personal data are processed for the following purposes.

2.1 Basic purposes
Fulfilling the contractual obligations deriving from the supply of goods and/or services among the parties both in pre-contractual and contractual stages, with specific reference to fulfilment of the contract and payment of the agreed amount.
Complying with the obligations foreseen by the EU laws, as well as by laws and rules specifically related to accounting, fiscal matters, health protection.
Enforcing the rights, also of third parties, in law courts, arbitration tribunals, administrative courts.
2.2 2.2 Commercial purposes
Sending communications to monitor the relations with the customers. Planning and carrying out operative marketing activities. Informing about commercial and promotional activities, also concerning goods/services different from those for which the supply contract was agreed.

3. Data processing
The above data, collected in any form, from the concerned subject or otherwise, will be processed using paper documents and electronic tools, and organized in order to fulfil the above obligations and purposes.
However, the same data will be stored by means of technical and organizational methods necessary and suitable to minimize the risk of data destruction or loss, of non authorized access or not allowed processing.The methods are detailed in the "Programmatic document about data protection" required by the law. The data will be stored only for the period necessary to comply with the above obligations and purposes.

4. Data communication
The personal data, collected to achieve the purposes indicated at paragraph 2, can be communicated, depending on their specific professional authorities, to the following categories of subjects: individuals and/or legal entities, public and private subjects, fiscal offices, public security bodies banks, firms specialized in management of payments, law and fiscal consultancy firms, public authorities or administrative bodies for law obligations, financing and transport firms.
The same data can be made available to our employees depending on their specific jobs, as well as to external collaborators to whom we'll require to perform the processing in compliance with Gov. Decree 196/2003, pursuant with article 25 annex B.

5. Holder of data processing
The holder of data processing is Mr. Giorgio Mang, legal representative of Mager s.r.l..

6. Person in charge of data processing
The person in charge of data processing which can be contacted by the subject of data, in case of exercise of the rights indicated in article 7, is Mr. Giorgio Mang, domiciled at Mager s.r.l. - via Cavaglią 27, 10020 Cambiano (Torino).

7. Provision of data and consequences of a refusal
The provision of data is necessary for the correct determination and fulfilment of the relationship with you, for the purposes indicated at paragraph 2.1. The refusal to provide the data would not enable, in whole or part, the fulfilment of the agreed contract and, specifically, could imply the impossibility to carry out purchase orders, to provide the required services and their invoicing.
The provision of data is optional for the marketing purposes indicated at paragraph 2.2, for which we'll require your explicit consent.

8. Rights of the subject
The subject is granted the rights foreseen by article 7 of Gov. Decree no. 196 of 30 June 2003, whose text is annexed to this notice.

Article 7 of Gov. Decree no. 196 of 30 June 2003
(Right to access to personal data and other rights)

1. The subject has the right to obtain a confirmation of the existence of personal data related to him/her, even if not yet registered, and their communication in intelligible form.
2. The subject has the right to obtain the indication:
a) about the source of personal data;;
b) about the purposes and methods of the processing;
c) about the logic applied in case of electronic data processing;
d) about the identification of the holder, of the persons in charge and of the representative designed in pursuance of article 5, paragraph 2;
e) dthe subjects or categories of subjects to which the personal data can be communicated or which may get acquainted with such data as representatives designed in the territory of the State, of persons in charge or delegated.
3. The subject has the right to obtain:
a) ldata update, correction, or (when to his advantage) integration;
b) the deletion, the transformation anonymous form or the block of personal data processed in breach of law, including those for which storage is not necessary for the purposes for which they were collected or processed;
c) the declaration that the operations indicated in a) and b) have been reported, also concerning their contents, to those to whom data were communicated, except when this is impossible or implies a clearly disproportionate deployment of means in comparison with the safeguarded right.
4. The subject has the right to oppose, in whole or part:
a) for legitimate reasons the processing of personal data concerning him/her, even if pertinent with the purpose of data collection;
b) the processing of personal data concerning him/her for the purpose of sending marketing or direct sale materials or to carry out market researches or marketing communication.
